Good health and safety for ourselves and our loved ones are conditions most of us tend to take for granted even though they are essential to the quality of life and can change in the blink of an eye.
As we go about our busy daily activities rarely do we spend much time or energy thinking about what might or could happen. It’s comfortable to believe that our health and safety and that of those closest to us will not change, even though we know it could.
A life-changing event can take place anytime and anywhere. For example, someone drives too fast or is distracted by a cell phone or makes a wrong turn or decision and a car crash results or a doctor makes the wrong diagnosis or provides the wrong treatment or a dangerous product is sold and injures a user or someone else.
Helping injured people get fair treatment when they, or a loved one, have suffered physical and emotional and financial injury or harm caused by the negligence or carelessness of someone else is what I do.
The legal system is complex and can be confusing, especially to people who are not trained in the law. There are periods of time, “limitations”, by which certain things must be done. Generally, once a limitation period expires it’s too late to take any action. In both Iowa and Illinois, an injured adult has 2 years from the date she or he was injured to file a lawsuit against whoever caused the injuries. That time limitation is extended for minors (person’s not of legal age) and disabled persons. But, once that deadline expires it’s too late, absent some exceptional circumstance that could be a basis for a short extension, to file suit.
Do I have a good claim? How do I prove my claim? What evidence will be necessary? How and where do I get it? Should I file suit? If so, when and in what court should a suit be filed? Who should be named as the defendant(s)? What claims can I make against the defendant(s)? What legal theory or theories apply based upon the facts and the law? What types of damages am I entitled to? What about a settlement? How does that work? What about legal fees and the costs of a lawsuit?
